there is a war going on. one soldier tries to kill another soldier, but then unfortunately realizes that he has shot a civilian that had a bomb stuck onto him.
No he shouldn't-even if it is a civilian he had a bomb strapped to him-it could be described as self defense so if you want to be harsh maybe manslaughter but not murder.

If he just walks away and doesn't tell anyone, it never happened
No he did the right thing for not harming other people getting injured
